Introduction

Welcome to our Floral Keepsakes website. By accessing and using our website and services, you agree to comply with and be bound by the following Terms of Service. Please read them carefully. If you do not agree with any part of these terms, you should not use our website or services.

Eligibility: You must be at least 18 years old or have the permission of a legal guardian to use our website and services.

Order Acceptance: All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason.

Pricing: Prices are subject to change without notice. We strive to ensure that all prices on our website are accurate, but errors may occur. If we discover an error in the price of an item you have ordered, we will inform you and give you the option to reconfirm the order at the correct price or cancel it.

As a valued customer, it is your responsibility to be fully informed about the prices of our keepsake products. Prices for all items, including custom and non-custom pieces, are clearly listed on our website. We encourage you to review the pricing information thoroughly prior to placing an order.

In case you have any questions or need further clarification regarding the prices, please do not hesitate to contact us directly. We are not liable for any misunderstandings or discrepancies regarding product pricing that may arise due to a failure to check the prices on our website or inquire through our contact form found on the website.

Payment: A deposit of $200 is due at the time of flower drop-off. Place "Keepsake Deposit" in your cart, fill out your information, and checkout. The remainder of the payment is due within 3 days of notice that your order is ready for pickup or prior to shipping. We accept various payment methods, including major credit cards and PayPal.

Flower Requirements: 

Flowers must be received within 3 days of the event.

Some flowers, when dried, will change color and shape. 

Some flowers, if handled roughly, will bruise. Signs of bruising are impossible to see until resin is applied. This is completely out of our control, therefore we recommend not using bouquets that have been tossed for floral preservation.  

In some instances we are able to color correct and bring some of the color back to the flowers.  

We may also recommend substituting the same color and type of flower in place of a damaged or off-color flower 

DO NOT PLACE FLOWERS IN THE REFRIGERATOR. This will cause premature wilting and possible bruising. Keep flowers in fresh water as often as possible with a fresh stem cut following the event or service. Keep in a cool place away from direct sunlight. Pouring vase water out and refreshing it daily will also keep your flowers fresh.

If flower handling requirements are not followed, we have the right to refuse the order. You would be notified at the drying process stage. 

Customization: Custom orders require specific details and instructions. You are responsible for providing accurate information. We will not be liable for any errors resulting from incorrect information provided by you.

Production Time: Custom orders typically take 6-7 months to complete. Production times may vary based on complexity and material availability. We will inform you of any delays. Checking in on your order status is fine, but please remember the more texts like this that take time to answer, the less time I am actively working on keepsakes. I ask that you keep check-ins limited to EMAIL only to reduce distractions. 

Unclaimed Keepsake Policy

Once your keepsake is complete, you will be notified via email or text using the contact information you provided. If we do not receive a response or final payment within 60 days of notification, the keepsake will be considered abandoned.

Deposits are non-refundable. Abandoned keepsakes may be discarded, repurposed, or used as display samples, and Roots Floral Preservation is not responsible for storing unclaimed items beyond the 60-day window.

We understand life gets busy, so please reach out if you need more time—we’re happy to work with you!

Liability and Limitations:

Resin is a difficult medium to work with. There are many variables that influence curing, like temperature and humidity levels. We monitor all variables closely, but the formation of bubbles throughout the process of preserving your flowers will sometimes appear as the resin hardens. We ask that you please understand this process and that we cannot offer a refund for the presence of bubbles or debris (like silica) in your keepsake. Roots Floral Preservation is not responsible for any change or damage that may occur to flowers, keepsakes, or resin design during the preservation process. Additionally, we will do our very best to hold on to special items attached to your bouquet, but cannot be held responsible for misplaced items. Please remove any special handkerchiefs, brooches, etc before bringing your bouquet, unless you would like these items included in your keepsake.  

Intellectual Property

Ownership: All content on our website, including text, graphics, logos, images, and software, is the property of Roots Floral Keepsakes or its content suppliers and is protected by international copyright and trademark laws.

Use: You may not use, reproduce, distribute, or create derivative works from our content without our express written permission.

Limitation of Liability

1. Disclaimer: Our website and services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation of our website or the information, content, materials, or products included on our website.
2. Liability: To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. We will not be liable for any damages of any kind arising from the use of our website or services, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

Indemnification

You agree to indemnify, defend, and hold harmless Floral Keepsakes, its officers, directors, employees, agents, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, arising from or related to your use of our website and services or any violation of these Terms of Service.

Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the jurisdiction in which Roots Floral Keepsakes operates, without regard to its conflict of law principles.

Changes to Terms

We reserve the right to update or modify these Terms of Service at any time without prior notice. Any changes will be posted on this page and will take effect immediately upon posting. Your continued use of our website and services constitutes acceptance of the revised terms.
